Rick, Welcome aboard, and glad to know there is another hobby breeder. I think the future of fancy goldfish in the USA depends on dedicated hobbyists.

He downloaded my pictures, too, from the MGKS 2010 goldfish pictures that I posted a link to on here. I found them on another forum with him saying they were his fish and he showed them at MGKS THIS year....interesting, 2 of the fish are deceased....His picasa albums are FULL of our pictures, I recognized some of Ichthius, HN Lim and maybe Dan's. I don't have a problem with that so much if it is just because he likes the fish.....the thing that is disturbing is that I keep finding them used on other forums all over the internet with the implication and deception that they are his pictures and his fish.

I'm also getting conflicting information on what constitutes "infringement". Can anyone clarify?

Got 2 birds with one stone when I looked at that thread. Jaytard and this Rick dude. Both just a couple of....well I'm not going to bash I guess but I will keep an eye out for any content that he is stealing from you guys. I'm not sure how the laws work as far as pictures online. If he is claiming that they are his then there may be something that can be done. Hopefully someone will come along that can let you know for sure.

In summary, as I am understanding it:
When you take the photo, you own the copyright. You can get it officially "copywrighted" but it's not necessary unless you foresee a need to sue for compensatory damages if someone is making money off of it. One more thing I forgot to mention is the cost of copyright for photos in the U.S. is $59.00. For one photo or all the photos you have as long as you can send them all the copies.

be careful to not go overboard here.
"Fair Use (or Fair Dealing in some countries) permits copying for some purposes, but is a complex issue. Generally, copying is permitted for personal use, research, teaching, criticism, parody, news reporting and editorial use.
Beyond that, the law is deliberately vague and is decided on a case-by-case basis. A lawyer can render an opinion, but there’s no accurate answer until a case is adjudicated by a court. Questions include: how commercial was the use, has the market of the original work been affected, how different is the derivative work, has a significant amount of work been copied. Note that “fair use” is an “affirmative defense", where the infringer has the burden of proof to show that the use was indeed fair."
fair use is a very broad concept. unless the use is commercial and someone is receiving or losing monetary gain as a result of usage, you are likely in the fair use zone. if i am a comercial photographer and post images in a photobucket for sale and someone takes them it is different than if i am not a professional photographer, i don't sell photos, and i post them for the world to see.
copyright in the modern age is more appropriately called "usage" rights. without monetary loss or gain, infringement is really hard to prove especially if the owner posted them in a public forum such as photobucket or here without an attached statement about their intent to restrict usage. otherwise it is implied fair use within the areas related in the quote. if you don't want others using your images, you must state that (preferable in the image) otherwise permission is implied as you gave the file away by posting it.

Your right, if someone would take one of my photos and sell then all over the stores I would take action, otherwise it is not worthed the legal fees.

For me it's about outing this creep. The harm is really to those in the other forums who thought he was what he was portraying.
I think we should put this to bed and take down the warning. Lets not let this troll live on.
PS. All the other forums have shut down that user name and we should do the same so they do not have access to the content of this site (atleast under that name).

Very interesting indeed! I see at least 20 pictures of my fish there. Someone even used pictures of my tikus claiming them to be theirs. Oh well, at least the truth is out there.
